Legal NoticesThe September 2006 issue of the Bear News contained a number notices regarding the legal rights of parents and students. These notices are reprinted here. They include:
Annual Notification of Pest Control Procedures This serves as annual notification of the District's pest control procedures as required by Chapter 17.21 RCW, The Pesticide Application Act. At this time the district does have a formal pesticide policy. In this letter of notice you will be informed in general of our pest control practices, how to register for pre-notification of pesticide applications and posting at time of application. In terms of current control practices, the District uses a limited number of pesticides as approved by the Department of Agriculture for broad leaf and weed control. These are applied as needed, approximately twice a year. This use is to address specific pest problems such as clover and dandelions on our playing fields. Pesticides White Salmon Valley School District uses on a regular basis include: Round Up, Confront, Weed N Feed and Caseron. Pesticide application is done by in-house personnel who are trained as certified applicators. For applications that are made to school grounds, the notice must be posted at the location of the application and at each primary point of entry to the school grounds. Notification signs shall remain in place for at least twenty-four hours from the time the application is completed. The notice must be no smaller than four inches by five inches and state "This landscape has been recently sprayed or treated with pesticides by your school". The notice must also include the name of a person to call for more information. If you would like to be pre-notified, please send written notification to: White Salmon Valley Schools, Administration Office, PO Box 157, White Salmon, WA 98672 or fax it to 509-493-2275. You will be pre-notified, in writing, a minimum of 48 hours prior to each application. This notice will state the location, intended date and time of the application, the pest to be controlled and the name and telephone number of the contact person at the school. Moreover, at the time a pesticide is applied, the school must post notice at the location(s). Moreover, the school is required to maintain an annual summary of all pesticide applications. This summary is a matter of public record and is readily available at the administration office for review by any interested person. In closing, with the implementation of these new requirements, the District is in compliance with Chapter 17.21 RCW, The Pesticide Application Act. Please contact the district office (509-493-1500) if you have any questions about how the District is addressing these new regulations as we strive to maintain healthy and safe school environments. In its continuing efforts to safeguard students, staff, and public safety, the White Salmon School District 405-17 has adopted an Asbestos Management Plan. Such a plan includes any work that has been done in school facilities pertaining to surveillance, inspections, reinspections, response actions and post-response actions. The Management Plan is available to employees, parents, or others for inspection in the Superintendent's office or in any facility office. The district may charge a reasonable fee for copies of the Management Plan. Inquiries regarding compliance and/or grievance procedures may be directed to the school district's Title IX/RCW 28A.640 officer and/or Section 504/ADA Coordinator: Howard Kreps, PO Box 157 White Salmon, WA 98672 All parents in the State of Washington of any child eight years of age and under 18 years of age shall cause such child to attend public schools and such child shall have the responsibility to attend full time when such school may be in session unless he/she qualifies as an exception under the law. Such exceptions 9nlcude private and home school options and other special circumstances. In an effort to encourage all students and their families to comply with the compulsory attendance law, new requirements have been added which include notifications of parents of non-attendance, scheduling of conferences, and other steps to eliminate or reduce a student's absences. District truancy procedures are available at school offices; and attendance exceptions are listed in the Compulsory School Attendance and Admission law, Chapter 28A.255, available at the district administration office or the public library.
Notification of Rights Under the Family Educational Rights and Privacy Act (FERPA) for Elementary and Secondary Institutions The Family Educational Rights and Privacy Act (FERPA) affords parents and students over 18 years of age ("eligible students") certain rights with respect to the student's education records. These rights are: 1. The right to inspect and review the student's education records within 45 days of the day the School receives a request for access. Parents or eligible students should submit to the School principal [or appropriate school official] a written request that identifies the record(s) they wish to inspect. The School official will make arrangements for access and notify the parent or eligible student of the time and place where the records may be inspected. 2. The right to request the amendment of the student's education records that the parent or eligible student believes are inaccurate or misleading. Parents or eligible students may ask the School to amend a record that they believe is inaccurate or misleading. They should write the School principal [or appropriate official], clearly identify the part of the record they want changed, and specify why it is inaccurate or misleading. If the School decides not to amend the record as requested by the parent or eligible student, the School will notify the parent or eligible student of the decision and advise them of their right to a hearing regarding the request for amendment. Additional information regarding the hearing procedures will be provided to the parent or eligible student when notified of the right to a hearing. 3. The right to consent to disclosures of personally identifiable information contained in the student's education records, except to the extent that FERPA authorizes disclosure without consent. One exception, which permits disclosure without consent, is disclosure to school officials with legitimate educational interests. A school official is a person employed by the School as an administrator, supervisor, instructor, or support staff member (including health or medical staff and law enforcement unit personnel); a person serving on the School Board; a person or company with whom the School has contracted to perform a special task (such as an attorney, auditor, medical consultant, or therapist); or a parent or student serving on an official committee, such as a disciplinary or grievance committee, or assisting another school official in performing his or her tasks. A school official has a legitimate educational interest if the official needs to review an education record in order to fulfill his or her professional responsibility. 4. The right to file a complaint with the U.S. Department of Education concerning alleged failures by the School to comply with the requirements of FERPA. Title IX/Chapter 28A.640 RCW Officer and Section 504/ADA Coordinator: Howard Kreps PO Box 157, White Salmon, WA 98672 Parents Right to Access Student Records White Salmon School District, in order to protect the privacy of parents and students and to comply with the requirements of Section 438 of the General Privacy act as amended, designates the following categories of personally identifiable information from student records as directory information: the student's name, photograph, address, telephone number, date and place of birth, dates of attendance, participation in officially recognized activities and sports, weight and height of members of athletic teams, dates of attendance, diplomas and awards received and the most recent previous school attended. It is the right of the parent of a student or any student who has attained the age of 18 to refuse to permit the designation of any or all of the afrementioned categories of personally identifiable information with respect to that student as directly information. Any such student or parent must notify the school district of scuh refusal within ten days of the publication of this notice. Scuh written notice should be addressed to Dale F. Palmer, Superintendent, White Salmon School District, PO Box 157, White Salmon, WA 98672 Notice of Parent right to Request Teacher and/or Paraprofessional Qualifications Parents must receive a notification of their right to request information on teachers' qualifications. If such a request is made, parents should receive information on whether teachers meet state certification requirements for the grade level and subjects they're teaching, whether they are teaching via provisional waiver or emergency permit, their degree major and field of discipline as well as any graduate certification they hold. If their child receives any services from a paraprofessional, parents should also be notified if the paraprofessional has met paraprofessional qualifications.
Annual Notification to Parents of their right to request public records relating to school employee discipline Pursuant to Chapter RCW 42.17 RCW, parents and other members of the public have the right to inspect and copy public records retained by the district, including records pertaining to employee discipline, unless the records are exempt from public disclosure under state law. |
